In order to be transparent and seek input from the diverse business and labor communities, L&I is further seeking stakeholder feedback on draft administrative policy, ES.C.10, Frequently Asked Questions About the Family Care Act.

We are asking the public to review the draft of the administrative policy and provide written feedback by October 18, 2024.

My name is Michael Gonzales, I'm a 43 years old, and I worked for Active Construction from 2021 untilApril 22, 2025, as a [Job Title], earning $47 per hour.On April 22, 2025, I was verbally fired after being accused of speeding through a work zone anddamaging traffic control equipment at a Kiewit jobsite in Forks, WA. No police spoke with me, nolicense plate was recorded, and no physical evidence has been shown. I had already passed thearea by the time the incident allegedly occurred. I was never given the chance to explain or defendmyself-my termination was based solely on secondhand accusations.I also believe this termination was influenced by prior retaliation for my FMLA leave from April to July2024, which I took to care for my wife. My supervisor made several negative comments about myabsence, including, "You left me hanging all summer," and implied I was taking free time off. I havea recorded phone call as evidence of this.Since I started at Active Construction, I have consistently been denied legally required 15-minuterest breaks and 30-minute meal breaks, despite working long and physically demanding days. I'veseen others laid off or passed over for work simply for requesting a lunch break, creating anatmosphere where workers are afraid to speak up.I am seeking legal assistance for:- Wrongful termination without investigation or evidence- Retaliation for protected FMLA leave- Ongoing violations of Washington State labor law- A hostile work environment that punished lawful behaviorI'm happy to provide recordings, a timeline, and additional documentation upon request.
