EAP Rulemaking Statewide Feedback Sessions

Washington’s overtime employment rules are changing – and we want to hear from you!

The Department of Labor & Industries (L&I) is changing employment rules that determine which salaried employees in Washington are required by law to receive overtime pay, minimum wage and paid sick leave. These changes will affect Executive, Administrative, and Professional (EAP) workers across all industries in Washington State.

Changes to these rules will mean some employers will have to provide overtime, minimum wage, and paid sick leave to employees who previously were considered exempt. These employees will have new rights and protections under the Minimum Wage Act.

In April 2018, L&I started meeting with representatives from business and labor organizations to exchange ideas on key issues that will be addressed in the process of changing the employment rules.

Opportunity to review pre-draft rules
In October 2018, the department circulated an initial pre-draft version of updates to the rule language. We used feedback received from stakeholders to create a second pre-draft version of the rules, which can be located on the pre-draft rules page here.

Feedback sessions in November
Employers and employees are encouraged to attend one of L&I’s feedback sessions below. You’ll learn more about the possible changes for salaried employees and have an opportunity to provide input on the pre-draft version of the rules. If you attend a feedback session, you can still provide input online or by email. A copy of the presentation being provided at the feedback sessions is available here.

Next steps
L&I will consider input from these feedback sessions to prepare the draft rules. After L&I releases the draft rules, we will hold public hearings and the general public will have an opportunity to submit formal comments before they are finalized. The rulemaking timeline will be updated as dates are set.
